China has refused more than 150,000 malicious trademark registration applications in the past three years, and has established a blacklist system.

He Zhimin, deputy director of China National Intellectual Property Administration (CNIPA), said that in the past three years, the office has refused more than 150,000 trademark registration applications for malicious registration and hoarding, confirmed 220,000 abnormal patent applications, and established a blacklist system for malicious registration in Beijing on the 8th.

During the 13th Five-Year Plan period, the CNIPA focused on improving the level of public service facilitation and improving the public sense of access, and made remarkable achievements in promoting the reform of “Streamlining administration, delegating power, strengthening regulation, and improving services” in the field of intellectual property.

 

Among them, in terms of strengthening fair supervision and creating a fair and orderly environment, resolutely cracking down on malicious trademark registration and abnormal patent applications, and maintaining good market order, in the past three years, more than 150,000 applications for malicious registration and hoarding of trademarks have been refused, and 220,000 applications for abnormal patents have been confirmed.

 

In terms of breaking unreasonable barriers and reducing institutional transaction costs, the 13th Five-Year Plan has reduced patent and trademark fees by 47.17 billion yuan, and reduced more than 15 million patent and trademark application materials.

 

In terms of increasing the opening of basic data, more than 5200, 000 trademark data and 34 kinds of patent basic data already have been opened freely.

 

He Zhimin pointed out that last year, the CNIPA specially formulated the implementation opinions on severely cracking down on a bad faith application for trademark registration for a purpose other than use, establishing a joint working mechanism, forming a multi-department linkage of the whole process of combat, and achieving positive results. Since the beginning of this year, more than 10000 malicious trademark registration applications for a purpose other than use have been refused by applying the new Trademark Law in the substantive examination of trademarks.

 

The CNIPA has also established a blacklist system to blacklist some applicants with more malicious registration behaviors, strictly supervise relevant new applications, and add nearly 1000 suspected malicious trademark registration applicants. In addition, in terms of strengthening the supervision of the agency industry, local law enforcement departments should be organized to investigate and deal with the illegal acts of the agency, and cracking down on the malicious trademark registration application agency for a purpose other than use should be promoted as an important part of the special action “Blue Sky”.

 

He Zhimin said that in next step, the CNIPA will constantly improve the trademark legal system, strictly examine according to law, increase punishment, strengthen credit supervision, timely expose cases, promote brand construction and the high-quality development of intellectual property.
