[Brief Of the case]

Hangzhou Leisu Cleaning Equipment Co., LTD. (hereinafter referred to as Leisu Company) is the patentee of a utility model patent (hereinafter referred to as the patent involved) whose name is "Anti-drop hanging walking system of car washing equipment"; Later, Hangzhou Oushuo Cleaning Equipment Co., LTD. (hereinafter referred to as Oushuo Company) submitted a request for invalidation and relevant evidence to the National Intellectual Property Administration, (CNIPA) on the grounds that the case was not in compliance with relevant provisions of the Patent Law. In order to maintain the patent, Leisu Company entrusted us to protect rights.

The case went through written proceedings and oral proceedings, and the case was finally closed by CNIPA because of the withdrawal of the request for invalidation by Oushuo Company.

[Experience in handling cases]

In this case, Oushuo Company produced and sold a number of products that were suspected of infringing the patent right of Leisu Company and caused bad market influence. During the process of handling the case, we grasped the point that the evidence provided by Oushuo Company was different from the technical field of the patent involved, and analyzed the technical problems faced by the equipment in different fields from the perspective of the technical field, as well as the differences of the measures taken to solve the corresponding technical problems. Then we expounded the substantive difference between the patent and the evidence involved in the technical solution itself, and the face-to-point defense idea maked the collegial group have a clear judgment on the difference between the entire technical solution and the evidence solution of the patent involved,  forcing Oshuo Company to take the initiative to withdraw the request for invalidation and successfully defend the rights of our parties.
